Injured by a Doctor? Don’t Wait to Sue

Medical negligence can easily result in serious injury or death. Healthcare professionals don’t set out to make mistakes, but when medical errors are made, the results can be disastrous.  It can be a downright traumatic experience that will have family members and victims alike reeling in emotional turmoil for months.

That being said, it’s not always easy to figure out the full extent of the injuries caused by a negligent doctor, nurse or healthcare facility. Sometimes, it can take months or years for someone to fully know how much damage was caused and whether the repercussions will be lifelong. Unfortunately, the statute of limitations for medical malpractice suits in the state of New Jersey is exceptionally small considering the serious damage medical negligence can cause.

In general, a person who is filing a lawsuit for medical negligence or malpractice must do so within two years of the actual incident that happened. If you don’t file within those two years, you will most likely lose your right to sue for damages unless you fall into one of the following exceptions:

  • You could not have reasonably known that you had a malpractice case until now. (Should this happen, the statute of limitations is waived.)
  • You were a child under the age of 18 when the malpractice occurred
  • If your child sustained an injury at birth, you have up until the child turns 13 to file a lawsuit for malpractice.
  • The doctor who harmed you left the state afterward and could not be tracked down in time
  • The victim of the malpractice was mentally ill or disabled

Unless you fall into one of these categories, time is of the essence when considering whether or not to file a medical malpractice lawsuit. Your best bet is to consult with an experienced medical malpractice lawyer who can review what happened and determine if your case is worth pursuing. Similarly, if your relative is incapacitated due to malpractice, or if you believe that there may have been a medical mistake that injured your loved one, it is up to you to reach out to a lawyer before the statute of limitations has run out.

If you suffered a medical injury you believe was the fault of a doctor’s negligence or mistake, you may have a case. Call the Law office of Craig A. Altman for a consultation today.
