  • You could not have reasonably known that you had a malpractice case until now. (Should this happen, the statute of limitations is waived.)
  • You were a child under the age of 18 when the malpractice occurred
  • If your child sustained an injury at birth, you have up until the child turns 13 to file a lawsuit for malpractice.
  • The doctor who harmed you left the state afterward and could not be tracked down in time
  • The victim of the malpractice was mentally ill or disabled

Unless you fall into one of these categories, time is of the essence when considering whether or not to file a medical malpractice lawsuit. Your best bet is to consult with an experienced medical malpractice lawyer who can review what happened and determine if your case is worth pursuing. Similarly, if your relative is incapacitated due to malpractice, or if you believe that there may have been a medical mistake that injured your loved one, it is up to you to reach out to a lawyer before the statute of limitations has run out.
